What the State Must Prove to Obtain a DUI Conviction

Oklahoma Statute § 47-11-902 is the DUI law. You can be convicted of DUI if you are in physical control of a motor vehicle and you:

  1. Have a blood alcohol concentration of 0.08 or higher; or
  2. Have any amount of a Schedule I controlled substance in your blood; or
  3. Cannot drive safely because you are under the influence of alcohol or drugs.

As you can see, you can be convicted of DUI regardless of the number you blow on a breathalyzer. For example, someone with any drugs in their system can be convicted if the drugs impair their ability to drive normally.

What Criminal Penalties Are You Facing?
