How Oklahoma Law Defines--and Punishes--Domestic Violence

Most Oklahoma criminal domestic abuse cases involve charges of assault or battery. Assault refers to the willful and unlawful attempt to use or threaten violence against another person. Battery means actually using such force or violence. In other words, if you brandish a knife and threaten to harm your spouse, that is assault. If you actually cut them with the knife, that is battery.

Obviously, assault and battery are crimes regardless of the relationship between the perpetrator and the victim. But when those crimes are committed against family members, Oklahoma law classifies it as domestic abuse. In fact, the Oklahoma legislature recently amended the state's domestic abuse laws to impose harsher sentences. As of November 2024, a person convicted of domestic abuse will face the following penalties:

  • Assault and Battery: Any assault or battery committed against a current or former intimate partner, or a family or household member, may be sent to county jail for up to 1 year and/or fined $5,000. A subsequent domestic abuse conviction carries a maximum sentence of up to 4 years and a $5,000 fine.
  • Dangerous Weapon: If the domestic abuse involves the use of a sharp or dangerous weapon, it is a felony punishable by up to 10 years in prison.
  • Use of a Deadly Weapon: If the domestic abuse involves the use of a deadly weapon, it is a felony punishable by a maximum term of life in prison.
  • Pregnant Women: Domestic abuse against a pregnant woman, assuming the defendant knew of the pregnancy, is a misdemeanor punishable by up to 1 year in jail for a first offense, and up to 10 years in prison for a subsequent offense.
  • Presence of Children: Domestic abuse committed in the presence of a child--even if not directed against that child--is a misdemeanor punishable by a term of 6 months to 1 year in jail and a $5,000 fine.

This is not an exhaustive list. But the point should be made clear: A person charged with attacking or harming a spouse, partner, or other family member is looking at serious jail time if convicted.
