So the first step is to go on a first date! In this case, the first date is usually a phone call (and maybe you cyber stalk us first and read our reviews and check out our website!). During that phone call (aka first date) it is usually clear pretty quick if you are going to be a good fit for our law firm, and if we are a good fit for you.
Not everyone who contacts us looking for an attorney is a good fit for us and our services. And that's okay.
Simply put, we can’t accept every case that people contact us about.

If you have made it to Step 3, that means that we decided that we are a good fit and you have become a client. You made a great decision by putting your faith in Fassio Law and hiring us to represent you in your criminal case.
Ok, what is Step 3? Well, this part is kinda boring for you. But just hang out and let us take care of it!
At this point, our team is working to find out as much information as we can. As you can imagine, the more we know about the situation, the better.
You have probably heard the famous quote “Knowledge is power.”
So we are working behind the scenes to gather as much knowledge as we can. You take it easy right now. Focus on your life outside of this case. Take a deep breath, spend some time with your family and friends (assuming they didn't play a role in landing you in this mess in the first place!), and try to get your 8 hours. If you're not sleeping, your home life, your job, everything is going to suffer.
So just try to calm down. I know that's easier said than done, but try.
When you hire us, part of our job is to do the worrying for you.
Your job at this stage: go to work, go on a picnic, take a nap, binge watch or read something light and uplifting (I recommend The Office, Ted Lasso, The Happiness Project, or You Are a Badass), or play hide-and-seek with your kids or your dog.
Our job at this stage: gather information from you (ok, so you have one more job at this stage: give us info when we ask for it) so we have a complete picture, starting a file, and setting up super boring internal stuff.
At this point, we are also working on obtaining “discovery,” which is basically a summary of the evidence that the prosecution has (most of the time this consists of the police reports, and sometimes there is video from the officers or other items of discovery).
I think of discovery as the best game of poker ever: they have to show us their cards, we do not have to show them ours! We usually get discovery from the prosecutor, and sometimes we attempt to obtain it from an Open Records Request. Again, this is boring stuff you don’t need to worry about. Go pack your picnic basket!
Obtaining discovery can take anywhere from 5 minutes to 5 months. I know, I know, super frustrating. But just know - we are on it! So if you just hear crickets for a while and think nothing is happening, don’t worry. This is not unusual or a sign that anything is wrong. Sometimes (most of the time) the wheels of justice move slower than my grandfather’s tractor!
And we are getting ready for court. Don't worry, nothing much will happen at the first few court dates! You just need to make sure you show up (unless we told you that you don't have to appear for a particular court date). Be on time and dress like you're going to church. Even if you don't go to church, you have probably seen other people so you know what we’re talking about.

Ok, this part might be kinda boring for you too, because this is more behind-the-scenes stuff. But that means that now you get to go to the movies, take another nap, or get caught up on housework.
But hey, this is what you are paying us for!
At this stage, we have all the information from Step 3, so let’s see what is in there!
We start with what we call a “discovery review.” I bet you can guess what this consists of: During the discovery review, we . . . (drumroll) review the discovery!
Then, once we know what we are up against (again, best game of poker ever!), we go through a process that we refer to as “issue spotting.”
I call it that because in law school most of the assignments were in the “IRAC” format. IRAC stands for: Issue, Rule, Application, and Conclusion. Ok, enough about law school. But you see where I'm going with this…
Issue spotting is going through the discovery and “spotting” any legal “issues” or potential issues.
So this is one place where law school (and years and years of criminal law experience!) pay off. We know what to look for.
If you have ever heard of a “SWOT analysis,” issue spotting is kinda like that. SWOT stands for: Strengths, Weaknesses, Opportunities, and Threats.
So during our issue spotting, we are combing through the discovery, and any relevant info from outside the discovery (like stuff you told us), and relevant statutes and case law and identifying the Strengths, Weaknesses, Opportunities, and Threats that are present in your case.
Again, knowledge is power. So once we know what's there, we can begin to tackle ways to minimize the weaknesses and threats in your case, and maximize the strengths and opportunities.
Whew, almost finished with Step 4. I hope you're enjoying that movie! Psst pass the popcorn.
Then, once we know what we are up against (again, best game of poker ever!), we go through a process that we refer to as “issue spotting.”
Next, while “you do you,” the Fassio Law team is having a Case Review Meeting to discuss and analyze your case. Basically this is the elevated, team version of issue spotting. As you know, two heads are better than one. During this meeting we brainstorm and utilize creative problem solving to create and identify OPTIONS and solutions. The more options you have, the better!
Creative problem solving is the name of the game!
“To the man with only a hammer, every problem looks like a nail.” We want to avoid this at all costs! Hand me a screwdriver, a tape measure, a wrench, even a circular saw!
And where we end up is: we know the strengths and weaknesses of your case, and we have identified as many options as possible. (There are 3 basic options that we discuss elsewhere, but this is about finding creative ways to “tweak” and expand those basic options.)

*For the record, I have to say: I know you (probably) won't be sitting on a beach chilling during this whole process. I know it's stressful and anxiety provoking, and you have had your plate full managing your life, your family, your job, etc etc etc, on top of this court case.
This is the stage where we are going to have an in depth conversation with you about what we have been doing and what we have come up with. We have probably had some mini discussions with some tidbits, but before now it was premature to discuss options and strategy in depth. Now is the time.
I have to be honest: often this is not a fun conversation. For example, if your case is full of W and T (weaknesses and threats), and S and O (strengths and opportunities) are hard to come by.
But this is the Fassio Law Pledge: We will make it as good as possible. We don’t have a magic wand that can just make everything “go away,” but we will make sure you end up with the best outcome possible for your situation.
That might be kind of a downer, but being honest and upfront is something we don't compromise. It is one of our core values. So, unlike some other attorneys, we won't promise you a happy ending when that ending is never going to come.
Now that that is out of the way…
During your Strategy Session we will walk you through the discovery, discuss the various options and strategies that we have uncovered and identified, and we will give you our advice and opinion about each of those options and strategies. And of course you can ask any questions that you have.
Then, with our help, you will decide on the course of action that you want us to take. Together.
Finally, we are going to work together and pursue that course of action to try to accomplish your goal. This could involve filing motions and having hearings before the judge, scheduling your case for preliminary hearing or jury trial, pursuing plea negotiations, working on mitigation, or applying to a diversion program.
