Am I Going to Jail because of a Shaving Kit?? John’s Story

He had never done anything like this before. Not even close. John had spent his entire life following the rules, to the point where people often jokingly called him a “goody-two-shoes.” And then one day, he just lost his mind for a minute. Now all of the things that he had worked so hard for were at risk: his marriage, his reputation, his position in the church, his job, the respect of his children, everything.

John had no idea what happened, no idea what possessed him to do what he did. The weekend before he had messed around in his garden for a couple of hours, gone to church, cooked dinner for his wife, gone to a weekend matinee. That was his life. Slow, calm, and perfect.

He made plenty of money, so there was no reason to try and steal the shaving kit. But he had a stressful day, and this weird impulse struck, and he did it. And now he was going crazy. Crazy with worry, crazy with stress, crazy with embarrassment, and crazy thinking he didn’t even know himself. He still couldn’t even fathom that he did this, it was almost like watching someone else do it.

He tried to steal the shaving kit, he got caught, and the store loss prevention manager called the police. They put handcuffs on him. Again, it felt like a bad movie; this couldn’t be real, this wasn’t his life. He was confused, stressed, and flat-out scared.

But he knew one thing for sure: He had zero experience with anything like this, so he had to make sure he hired a lawyer who had plenty of experience. Someone who could understand his situation, and who was willing to take his concerns into account and figure out a solution.

Are these serious crimes?

Yes. Depending on the value of the property and the circumstances alleged, theft crimes can be charged as a misdemeanor (larceny) or a felony. Also, keep in mind that you could be facing lots of fines, jail and/or prison time if you are convicted of a theft crime, especially for the most serious charges - like burglary and robbery. It is important that you get the proper defense for your case. The District Attorney must prove a number of factors to successfully prosecute a theft case, so you need an attorney that can hold them to this burden.

Not having the proper defense can severely limit your chance of getting a good outcome in your case. With the experienced criminal defense team from OKC Theft/Burglary/Larceny Firm, Fassio Law, you give yourself the advantage of having a knowledgeable and experienced attorney; this could mean the difference between spending many years in prison vs. spending no time in prison.

What are the penalties for theft charge crimes?

They depend on the specific crime you are charged with.

Someone convicted of petit larceny (aka petty larceny) will face a maximum of 6 months in county jail and a fine up to $500. That’s for stealing property valued at less than $1,000. So if you steal a small item from a store, you could end up in jail.

More serious theft crimes carry more serious penalties. First-degree burglary, which involves breaking into someone’s home with intent to commit a crime therein with a dangerous weapon, is punishable by up to 20 years in prison. Even third-degree burglary, which can include breaking into someone’s car with the intent to steal something inside, can land you in prison for a maximum of 5 years. And that doesn’t include fines and other penalties.

Other consequences of a criminal conviction

A conviction does more than cost you money in fines or restrain your freedom by sending you to jail. Anyone with a theft conviction, no matter how small, can face serious problems in the future. For example, your criminal history will come up in the following situations:

  • Job applications and interviews. More Oklahoma City employers are asking about criminal convictions, and they probably won’t hire you to work around money if you’ve been convicted of theft. For example, you could struggle to land a job working in a retail store, grocery store, or bank with a theft conviction. Some businesses won’t even interview people with criminal histories.
  • Apartment rentals. Landlords often strive to avoid renting to people witha criminal record. If you were convicted of burglary or robbery, they might be afraid you are violent.
  • Professional licensing. Some people struggle to get a professional license given their criminal background. Even highly educated professionals like doctors could lose their licenses.
  • Loss of civil rights.Convicted felons lose the right to sit on a jury and temporarily lose voting rights. Under Oklahoma Statutes § 21-1283, convicted felons cannot have a “deadly firearm” in their possession, which means they lose their gun rights.

Moving forward positively in your life can be very difficult. It’s time to meet with an experienced attorney to see if you can fight back against these charges and keep a conviction off your record to begin with.

Plea Deals and Theft Charges

Many people wonder if they should accept a plea deal. It sometimes works to your advantage. However, you shouldn’t just automatically accept a plea deal. The reality is that the state’s evidence could be weaker than you imagine. A plea deal might not make sense if you can instead get the charges dismissed due to police errors or get acquitted when the evidence is lacking. Before you can know if a plea deal is right for you, you need an experienced Oklahoma City theft defense lawyer to review all the facts.

Should I try to get a Public Defender?

We strongly encourage everyone to hire their own attorney if possible. Public defenders are often juggling hundreds of cases at one time. Even if they can dedicate significant hours to your case (and they usually can’t), you do not get to choose your own public defender and could get stuck with one who is not a good match for you and your case.
