Defending Yourself Against a Gun Charge in OKC

Of course, a criminal charge is not a criminal conviction. You have every right to zealously defend yourself against a gun charge in Oklahoma. Here are some notable legal defenses that can be raised in these cases:

  • Lack of Probable Cause to Search (Invalid Search): Lack of probable cause asserts that law enforcement officials didn't have a valid reason to initiate the search or seizure that led to the discovery of the firearm. If successful, this could lead to the exclusion of the gun as evidence.
  • Self-Defense: You may be able to claim self defense. Under Oklahoma law, you have the right to protect yourself and your property, given that the force used is proportionate to the threat faced. If you can prove you were in immediate danger, this defense might be applicable.
  • Insufficient Evidence: It is the State's burden to prove you violated a gun charge law. Make sure you have a lawyer who will hold them to this burden. Among other things, you may be able to dispute the reliability of witness testimony or argue that the physical evidence does not definitively link you to the crime.

Is a Stupid Decision about to put you behind bars?? - Gun Charges

James made a stupid decision, maybe the worst decision he had ever made in his life. And now the prosecutor was trying to put him in prison. The stupid decision was stealing a trailer.

But the worst part is that's not even why the D.A. wanted to put him in prison. He had a gun in his car at the time that he stole the trailer. A gun that he lawfully owned.  A gun that had nothing to do with stealing the trailer and was never even in his hand that night. But because he had it in his truck when he stole the trailer, he was charged with possession of an offensive weapon while committing a felony.

And prosecutors don't like gun charges.

James hired Fassio Law to help keep him out of prison. He knew the cops had him cold on the stolen trailer, but it was the gun charge that he was worried about. He had to spend a few days in county jail while he was waiting to bond out, and more than anything, he did not want to go back there.
 
We had to explore a lot of different options to help James. We had a preliminary hearing and tried to argue to the Judge that this gun had nothing to do with the stolen trailer.
 
James was set in front of one of the most difficult judges in the area, and she would not dismiss the gun charge. Trying to talk to the D.A. was like talking to a brick wall. Things were not going well.
Because Fassio Law is familiar with the judges and knew what type of argument was likely to work with this particular judge, we decided to do a blind plea, where the judge determines your sentence.
 
It's a risky move, but calculating in all the knowledge and experience that we had, we decided that this was the way to go.
Fast forward to sentencing day. James still remembers the feel of sweat trickling down his neck as the D.A. asked the Judge to send him to prison. The rest of his time in the courtroom was kind of a blur for James.
 
But what he does remember is walking out of that courtroom after the sentencing hearing, because he had just been granted probation!
